General Terms and Conditions (AGB)
1. purpose and scope of application
Unless expressly agreed otherwise in writing, these General Terms and Conditions (GTC) apply to all customers of “jobwalk Karriereevents”. Information in the brochures, leaflets and price lists is for information purposes only. Like these GTC, they can be changed at any time without prior notice and without giving reasons.
2. order receipt/acceptance and duration
2. 1. every order can be placed in writing (post, fax), electronically (e-mail) or verbally. The contract is legally binding when jobwalk Karriereevents sends a corresponding confirmation or invoice to the customer, either in writing or electronically. These general terms and conditions are an integral part of the order and the customer accepts these general terms and conditions without reservation when placing the order.
2. 2 There is no entitlement to the conclusion of a contract. jobwalk Karriereevents is free to reject any offer from a potential participant of the event to conclude a contract without giving reasons.
3. terms of delivery and payment
3. 1 If, for unforeseeable reasons, the delivery or provision of a service is not possible on the contractually agreed date, the participant may not withdraw from the agreed contractual service. Delivery is deemed to have been made when the service has been sent by jobwalk Karriereevents in the agreed form either in writing (post/fax) or electronically (e-mail/Internet). If the delivered services do not correspond to the contractually agreed form in terms of quality or scope, the customer must assert his complaints in writing within 8 days. Otherwise his rights shall be forfeited.
3.2. The participation fee is due before the start of an event and must be transferred to the designated account within 10 days of invoicing without deduction. The detailed scope of the service provided or rendered by jobwalk Karriereevents with the amount paid is precisely regulated in the contract. Only the contractually agreed services are included in the participation fee.
On request, payment in installments can be agreed for the participation fees under certain conditions. The installments are to be paid monthly in advance.
3.3. The stated event fee is exclusive of statutory VAT. Any additional costs for materials or travel are to be borne by the participant, unless otherwise contractually agreed in advance.
3.4. All services are subject to the statutory value added tax applicable on the date of invoicing.
4. change of address
Changes of address or other personal data during the collaboration must be communicated to jobwalk Karriereevents immediately.
5. copyright
Event participants are obligated to use all advertising materials and documents provided by jobwalk Karriereevents – unless otherwise contractually agreed – only within the scope of the events planned and organized by jobwalk Karriereevents. Individual use does not entitle the user to pass on, reproduce or distribute content to third parties. This also applies to photo, video and audio material produced before, during and after the event, which remains with jobwalk Karriereevents without restriction and with all rights of use and publication. Any other use requires the written permission of jobwalk Karriereevents. Commercial use of the information is not permitted. This also applies to access authorizations (e.g. passwords or keys).
6 Cancellation and modification of events
6.1. jobwalk Karriereevents reserves the right to cancel an event for organizational reasons up to one week before the start or to move it to another location. If events are canceled, rescheduled or relocated, jobwalk Karriereevents cannot provide compensation for any expenses incurred.
6.2. A change of event date or venue or changes to the course of the event or changes and updates to the content do not entitle the participant to withdraw from the contract or to reduce the fee.
6.3 If an event is canceled at short notice due to force majeure, illness or accident of the responsible organizer, insufficient number of participants or other circumstances for which jobwalk Karriereevents is not responsible, a replacement event will be held at a time determined by jobwalk Karriereevents, excluding any claims for damages. jobwalk Karriereevents will notify all participants as soon as possible. If the event is definitively canceled, the participant fees will be refunded, excluding any claims for damages.
6.4 If, for organizational and operational reasons, it becomes necessary to relocate booked stand spaces to another location, the Exhibitor shall be entitled to a comparable stand space (size and open sides). If the organizer is unable to offer the exhibitor a comparable stand location, the exhibitor has the right to withdraw from the contract. It is up to the organizer to make changes in order to ensure that the event runs smoothly.
7. vacancies
7.1. The publication of job offers on the website “https:jobwalk.city” is subject to a fee for non-exhibitors of the jobwalk. Even if the participation booking for a jobwalk event is made after the publication of an advertisement, the previously placed advertisements are subject to a fee. The invoice will be issued after the booking has been made.
7.2. The job advertisements are due for payment immediately after publication. Subsequently deleted or blocked advertisements do not release the advertiser from the payment obligation arising from the placement of the job advertisement.
7.3. Job offers with offensive, intolerant, political or racist content will be deleted.
7.4. The provider reserves the right to change prices. Price changes will be clearly communicated on the website and when ordering.
8. termination / dissolution of contract
8.1. If participation is canceled up to three calendar months before the start of the event, zero (0) percent of the participation fee is due. If participation is canceled between three calendar months and six weeks before the start of the event, 60 percent of the participation fee will be charged. If participation is canceled after six weeks before the start of the event, the full participation fee (100 percent) will be charged. Cancellations must be made in writing. The date of the postmark is decisive for meeting the deadline.
8.2. If the customer does not fulfill one of his payment obligations, jobwalk Karriereevents can unilaterally withdraw from the contract without any obligation. If the customer is in arrears with more than two installments, jobwalk Karriereevents is entitled to demand immediate payment of the entire remaining price plus 10 percent interest on arrears. In the event of unilateral termination of the contract by jobwalk Karriereevents, any deliveries already made by jobwalk Karriereevents must be paid in full.
9. exclusion from participation
jobwalk Karriereevents is entitled to exclude participants from further participation in special cases, e.g. default of payment (see section 7), disruption of the event and the course of operations. jobwalk Karriereevents is entitled to refuse to hold the event if individual or several participants do not follow the instructions of jobwalk Karriereevents staff despite requests to do so, or if the staff has the impression that individual or several participants are obviously under the influence of alcohol or other intoxicating substances. In these cases, there is no entitlement to a refund of the booking price.
10. liability
10.1. All procedures of the event have been planned by qualified employees to the best of their knowledge and belief and in compliance with all legal requirements. However, jobwalk Karriereevents is not liable for circumstances arising from unforeseeable events during the event.
10.2. jobwalk Karriereevents is not liable for damages incurred by customers and participants in connection with the planning and execution of events or coordinative measures, unless mandatory liability exists in cases of intent or gross negligence. jobwalk Karriereevents is not liable for damage, loss or theft of items or vehicles brought along. Liability towards participants and customers for any damage caused by postponement, cancellation or relocation is excluded.
110. Data collection and protection:
The participant agrees to the automated handling and processing of personal data for the purpose of planning and organizing the event and sending information by jobwalk Karriereevents. The address data may be transmitted to the cooperation partners.
12 Applicable law
The legal relationship between jobwalk Karriereevents and the customer is subject to German law, regardless of the performance of the services.
13. place of jurisdiction
The place of jurisdiction is Fürth.
14. severability clause
Should individual provisions of this contract not be legally effective or lose their legal effectiveness due to a later circumstance or should a loophole be found in this contract, this shall not affect the legal effectiveness of the remaining provisions. In place of the invalid contractual provisions or to fill the gap, an appropriate provision shall apply which, as far as possible, comes closest to what the contracting parties would have wanted if they had considered this point.
